Workers’ compensation is a no-fault system. You do not have to prove your employer did anything wrong, and in most cases you cannot sue your employer directly. In exchange, the law guarantees certain benefits. Here is how it works, based on the New Jersey Division of Workers’ Compensation:
Tell your supervisor as soon as possible. Notice can be verbal, but put it in writing too.
Your employer or its insurance carrier pays for authorized treatment. In New Jersey, the employer or carrier generally chooses the doctor, which is one reason disputes come up.
If a doctor keeps you out of work for more than seven days, you can receive 70 percent of your average weekly wage, up to the state maximum, paid back to the first day. For 2026, the state maximum is $1,199 a week, and the same cap applies to permanent partial, permanent total and dependency benefits (NJDOL).
If the injury leaves a lasting impairment, you may be entitled to permanent partial or permanent total disability benefits.
Death benefits are available to dependents when a work injury is fatal.
Claims for workers in Atlantic and Cape May counties are handled at the Atlantic City Workers’ Compensation Court, 1333 Atlantic Avenue, 4th floor (NJ Division of Workers’ Compensation). That is a short walk from our office. We know the process, the scheduling, and what the judges expect, and we attend your hearings in person.
You generally must file a formal claim petition within two years of the injury or within two years of the last payment of compensation. For occupational diseases, the clock usually starts when you knew the condition was work-related. Do not assume an informal hearing or a pending claim with the carrier stops the clock. It usually does not.

New Jersey law prohibits firing or discriminating against a worker for filing a claim.
Workers’ comp does not pay for pain and suffering. But if a person or company other than your employer caused the injury, such as a negligent driver, a subcontractor on a construction site or the maker of a defective machine, you may also have a separate injury claim. The workers’ compensation carrier is generally reimbursed from part of that recovery, so we need to coordinate the two cases. Because our firm handles both, we can.
